Don't purchase a car with financing through Drivetime unless you want the world to know your business.

We bought our first home a few years back. Unfortunately it seems that our neighbor choose badly whom to finance a vehicle purchase through and used DriveTime. Why do I say this, keep reading...

Over the past couple of years DriveTime has on occasion needed to contact the folks next door. According to DriveTime once we were even told it was because they were past due on their payment. To date they have called our house at least 5 times and more likely closer to 8. Every time they play stupid and act like its their first time calling us, the woman last night even tried to convince my wife that our neighbors ( who we hardly know and speak to ) had probably put us down as a reference. On several occasions they have asked us to suffer the humiliation of going next door and confronting these virtual strangers for them to tell them to call about their account going into default!

In November 2006 I was so damn frustrated with these harassing collection calls that had nothing to do with me (other than geography) I wrote DriveTime. Here is what I said.

I am writing in regards to your calls to my home in regards to try to locate my neighbor. If you are trying to locate him in regards to non payment of his account, by continuing to contact us you are in direct violation of Section 804 Subsection (3) of the Fair Debt Practices Act. According to that section of the law;
"ยง 804. Acquisition of location information [15 USC 1692b]

Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall --

(3) not communicate with any such person more than once unless requested to do so by such person or unless the debt collector reasonably believes that the earlier response of such person is erroneous or incomplete and that such person now has correct or complete location information;"

Its bad enough when we have to put up with sales calls, solicitations and other junk phone calls of our own. We will not tolerate your likely continued illegal activity. You have his address, you have his telephone number now leave us out of it. Any future calls will be considered harassment and will be handled as such, including legal action if deemed appropriate.

As you can see I was plain as day as we have been when on the phone with them. They still continue to call. I am guessing my only course of action left will be to consider legal action.
